1. Acceptance of These Terms

Welcome to HotPod (we, us, our). By accessing or using the HotPod mobile app, website, APIs, or any other HotPod-branded service (collectively, the Service), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions (Terms). If you do not agree, do not access or use the Service.

2. Modification of Terms

We may revise these Terms from time to time. Material changes will be announced via e-mail or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the revised Terms.

3. Eligibility

You must be at least 13 years old (or the minimum digital consent age in your jurisdiction) and legally capable of entering a binding contract to use the Service. If you are between 13 and 18, you represent that you have parental consent.

4. Account Registration & Security

• Provide accurate, current, and complete information.
• Maintain the confidentiality of your login credentials.
• Notify us immediately of any unauthorized use or security breach.

5. Intellectual Property

The Service, including software, design, text, graphics, and trademarks, is owned by HotPod or its licensors and protected by copyright and other laws. Except as expressly permitted, you may not copy, distribute, modify, or create derivative works.

6. User-Generated Content

You are solely responsible for any audio, text, images, or other content (UGC) you transmit via the Service. You must have all necessary rights to upload such content and may not post anything that is defamatory, infringing, hateful, or otherwise unlawful.

7. License You Grant Us

By submitting UGC, you grant HotPod a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, distribute, modify, adapt, publicly perform, and display that content in connection with operating and promoting the Service.

8. Prohibited Conduct

• Reverse-engineer or attempt to access source code.
• Transact in fraudulent, deceptive, or harmful activities.
• Upload viruses, bots, or any code that disrupts Service integrity.
• Bypass any security or authentication measures we employ.

9. Subscriptions, In-App Purchases & Payments

If you purchase a premium plan, fees are billed in advance on a recurring basis (monthly or annually) until you cancel through your platform's subscription settings. Taxes, currency conversion fees, and third-party payment-processor charges may apply.

10. Third-Party Links & Services

The Service may link to or integrate with services not controlled by HotPod. We are not responsible for those services or their content.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOTPOD WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

13. Indemnification

You agree to defend, indemnify, and hold harmless HotPod and its affiliates from any claims arising out of your use of the Service or violation of these Terms.

14. Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. Sections 5, 7, 11, 12, 13, and 15 survive termination.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of UK, without regard to its conflicts-of-law principles. Any disputes shall be resolved exclusively in the courts of that jurisdiction, unless mandatory arbitration or consumer-protection laws provide otherwise.

16. General Provisions

• Entire Agreement. These Terms constitute the entire agreement between you and HotPod regarding the Service.
• Severability. If any provision is found invalid, the remainder remains in full force.
• No Waiver. Failure to enforce any provision is not a waiver of future enforcement.
